Criminal Defense

  • All Felonies. An offense for which a sentence to a term of imprisonment in excess of one year may be imposed.

  • All Misdemeanors. An offense, other than a “traffic infraction,” for which a sentence to a term of imprisonment in excess of fifteen days may be imposed, but for which a sentence to a term of imprisonment in excess of one year cannot be imposed.

  • Violations. An offense, other than a “traffic infraction,” for which a sentence to a term of imprisonment in excess of fifteen days cannot be imposed.

  • Traffic Infractions. Any offense defined as “traffic infraction” by section one hundred fifty-five of the vehicle and traffic law.

  • All Felonies. Punishable by imprisonment for over one year .

    • Classified. According to severity as class A, class B, class C, class D, and class E.

    • Unclassified. There are unclassified felonies which are punishable by imprisonment but not designated under one of the classes listed above (some unclassified crimes may be deemed classified if they have the same maximum prison term as one of the classes specified above).

  • All Misdemeanors. Punishable by imprisonment for not more than one year.

    • Classified. According to severity as class A, class B, class C, and class D.

    • Unclassified. There are unclassified misdemeanors which are punishable by imprisonment but not designated under one of the classes listed above (some unclassified crimes may be deemed classified if they have the same maximum prison term as one of the classes specified above).
